On average, Northern Cardinals live for 3 years in the wild but they can grow as old as 15 years. The average lifespan in captivity is longer with the record set at over 28 years.

My wife and I were piss poor and getting finance degree at a third rate state college. I was paying my way with PC support. One day I spent money I didn't have to buy a Wndows NT certification book and used the university's T1 line to pirate NT 4.0 for myself and MS SQL and Oracle 7 for my wife (I also bought a CD of Red Hat Halloween).
Almost thirty years later we literally saved a presidential election and are the ones keeping significant parts of the US infrastructure from falling apart. All thanks to piracy.

Yes...but there is such a thing as a work addict. My father is in his eighties, hasn't had to work in decades, but still works like more than forty hours a week. I have no doubt that if he stopped, he'd be dead within the year.

My wife is also a workaholic but she's the equivalent to the alcoholic that wants to stop drinking but cannot. She just can't help herself to the point that she'll turn her own leisure time into a job.

I used to be the same but heart surgery and cancer cured me of that bullshit.

We currently have a stacked roster thanks to those mandates. Even more hilarious is that we are helping three clients who's projects are currently underwater because they lost key staff thanks to return-to-office mandates. We are not a staffing agency, we are a highly specialized firm, so right now they are paying six times the cost for specialists to do what they used to do with in-house staff. Funnier still, we have been a 100% remote work firm since 2012, so ultimately the office is still empty. SMH

A theory I read about the genesis of these attacks reads a lot like the plot of that terrible 1970's B-movie. It sounded far fetched TBH.

There is a theory I read that said that it was indeed a boat that accidentally killed a female's infant. She attacked and figured out that hitting the rudder would make them stop and then she proceeded to teach the pod.

Another I read was that it started as juvenile Orcas just fucking about and now it's turned into a preferred pastime. AKA, Orca hooligans.

Both seem anecdotal and not scientifically provable though.

JoMiran ,
@JoMiran@lemmy.ml avatar

They were able to trace the start of the behavior down to a single female. All the pods that are doing this are related to her. The "why" did they start is the mystery.

    I grew up drinking lightly pasteurized milk (still beige) and for a few years I drank raw milk because as an adult because it was the only way to get the full flavor I grew up with. So, I understand being raw milk enthusiasts because of flavor, but I sure as shit don't think the flavor is worth getting H5N1.

    The article discusses McDonald's but hidden gotchas in the TOS are becoming an industry standard. I shared the article because if McD is doing it, then it might be a good idea to look at your Taco Bell ToS closely, just in case.

    Clearly I didn't do a good job at making a clear statement with my previous comment.

    The problem is that unless the agreement explicitly states that the non-disparagment section applies only to the test playtest, the agreement would essentially place a gag order on that creator for the life of the game.

    JoMiran ,
    @JoMiran@lemmy.ml avatar

    What makes you think that? The language is fairly boiler plate and easily enforceable. We, "the company", give you, "the creator", an asset, "a free game copy", under the condition that you promise not to do or say anything that could diminish the value of the asset. Not only is it enforceable, it leaves room for compensatory damages if you are found in breach of contract.

    JoMiran ,
    @JoMiran@lemmy.ml avatar

    Early access to a game is not an asset you can "un-receive" just because you purchase your own copy later. Of course, you could make arguments against the terms being overreaching in court, but not many creators have the resources or desire for a legal fight.

    Other creators chimed in and said that they brought up the section in Discord and legal said they'd look into it. To me, this just seems as lazy copy and paste that they were warned about but did nothing about. Now they have a possible PR disaster on their hands unless they take swift action.

    PS: Apparently section 2.6 is way worse but it hasn't been shared yet.

    JoMiran ,
    @JoMiran@lemmy.ml avatar

    I see. That's not what "unenforceable" means. Unenforceable refers to a contractual responsibility that a court would never enforce. There are many reasons why a court would chosen to not enforce a contract but none of them are because a defendant doesn't have the means to combat it.

    See:

    @JoMiran@lemmy.ml avatar

    That is certainly something that can be argued in court, and the case might be very strong...but you'd still have to take it to court. Something else to consider is that if the agreement isn't clear about its limitations, then it can be argued that it isn't limited. All the company has to do is send you a key to the full game when it's available and they are technically still in compliance with the agreement. It would not matter if you tell them that you do not wish to participate anymore, or that you bought your own copy, you'd still be bound.

    JoMiran , (edited )
    @JoMiran@lemmy.ml avatar

    You might be right. This might not have been a mistake. Some creators in the Twitter thread said that they brought it up ahead of time but the company sent those agreements out as is anyway.

    JoMiran ,
    @JoMiran@lemmy.ml avatar

    Only fees that are entirely optional — like leaving a tip for staff — can be left out of the posted price.

    Wrong move. They should have outlawed tipping too. No more hiring for shit wages and leaving adequate compensation up to chance. Bump up the menu price and pay your staff an enticing salary.

    It is intentionally extremely broad, unconstitutional, and all around garbage so that even if it passed the house, it would be thrown out by senate, the executive, or the judicial. This is performative and it doesn't deserve you attention. Attention is all those clowns want.
